SnapProof Pro Privacy Policy

Your privacy is important to us.

SnapProof Pro (“we,” “us,” or “SnapProof Pro”) respects your privacy. This Privacy Policy (“Policy”) applies when you visit our website at https://www.snapproofpro.com (the “Website”), when you use our web and mobile applications (“Apps,” and together with the Website, the “Services”), when you interact with us over the phone, email, or other communication, when you apply for a position with us, visit us at a trade show or other event, or use another online website or platform that links to this Privacy Policy. In this Policy, we explain the types of Personal Information we collect and how we use, share, and protect that Personal Information.

WE MAY MODIFY THIS POLICY AT ANY TIME, SO PLEASE CHECK BACK REGULARLY FOR UPDATES. ALL CHANGES WILL BE EFFECTIVE IMMEDIATELY UPON POSTING TO THE WEBSITE OR APPS.

1. What Is Personal Information?

“Personal Information” (sometimes referred to as “Personal Data” in this Policy) is information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your household, or your device. Personal Information does not include publicly available information or aggregated information that does not include personal identifiers.

2. What Types of Personal Information Do We Collect?

We may collect the following categories of Personal Information through your use of the Services. We have collected the following categories of Personal Information within the twelve (12) months prior to the effective date of this Policy.

Identifiers

Examples:

Name, alias, postal address, phone number, unique personal identifier, online identifier, internet protocol (IP) address, email address, customer account name, social media handle, or other similar identifiers.

Retention:

We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for any other business or legal purpose.

Customer Records

Examples:

When you sign up for a free trial or a subscription, we do not directly collect credit or debit card information. All payment card data is provided directly to our PCI-compliant third-party payment processor. To confirm your payment, the processor may send us the last 4 digits of your payment card number and basic billing information.

Retention:

We retain this information for so long as you maintain an account with us, while we keep a business relationship with you, and for so long as required for our business and legal purposes.

Protected Classification Information

Examples:

For job applicants and employees, you may provide us with information about your gender, ethnic origin, or eligibility to work in the U.S.

Retention:

We retain this information for as long as we are required to by law.

Commercial Information

Examples:

Records of your subscriptions, content of texts, emails, or survey answers you send to us, in-service messages between customers, and purchases you made in the Services.

Retention:

We retain this information for so long as you maintain an account with us and for so long as required for any other business or legal purpose.

Internet Activity

Examples:

Internet or other electronic network activity information, including your IP address, browsing history, and information regarding your interaction with our Services, keyboard and mouse movements, online identifiers like cookie IDs, browser type, your internet service provider, operating system, and the date and time you used the Services.

Retention:

We retain this information for so long as you maintain an account with us and for so long as required for any other business or legal purpose.

Geolocation Data

Examples:

Imprecise location information, such as the city, state, or ZIP code associated with your IP address when you visit the Services.

Retention:

We retain this information for so long as you maintain an account with us and for so long as required for any other business or legal purpose.

Audio and Visual Information

Examples:

When you use the App, you can capture pictures and video of job sites, including the metadata associated with the photo or video, for your records.

When you communicate with our sales and customer service teams over the phone, we may record the call for training and quality assurance purposes consistent with Washington’s RCW 9.73 (which generally requires notice before recording a conversation).

If you agree to speak with us over a videoconference platform, with your prior consent, we may save a recording of the interview for our internal business purposes.

Retention:

We retain sales calls for at least three (3) years or for so long as you maintain an account with us. We retain any recorded video interviews for so long as needed for our business purposes. We retain your photos and your account information until you request us to delete your account.

Professional and Employment Information

Examples:

When you use the Services, this information may include your company name, your title, and other company details including address and phone number. When you apply for an open position with us, this information may include your employment history and work experience. If hired, this may include your Social Security number or other governmental identification numbers, financial account information, and other onboarding information.

Retention:

We delete your employment information in your account if you request deletion. Applicant and employee records are retained for as long as required by law.

Education Information

Examples:

Your education history and related information you provide when you apply for a position with us.

Retention:

We retain this information for as long as we are required to by law.

Sensitive Information: Precise Geolocation Data

Examples:

We collect your precise geolocation when you take a photo using the App, in order to associate the location with the photos you take.

Retention:

We retain the precise geolocation information associated with the photos you take in the App for as long as you have an account with us.

3. What Are the Sources of the Personal Information We Collect?

Information You Provide to Us

We collect Personal Information you provide to us when you subscribe to the Services, when you create an account, when you sign up for a free trial, when you provide us with feedback, when you communicate with us or other users of the Service, when you take photos or videos using the Services, when you participate in one of our promotions, or when you submit an application for an open position with us.

Information We Collect Through Other Customers’ Use of the Services

Other customers may provide us with your Personal Information in order to create your account or invite you to the Services.

Customers may upload photos and videos of work sites for their records that may include images or audio of you at the work site. We do not actively monitor uploaded photos or videos for Personal Information. Customers may input contact information about their clients (the person whose property they are working on, their “Clients”). We do not use this information for any purpose except to store it and process it on behalf of our customers. Our customers are responsible for obtaining your permission to collect your Personal Information.

Information Collected Automatically Using Technology

We use technology to automatically collect certain Personal Information relating to your use of the Services, including diagnostic and usage data that may be linked to your account.

Cookies and Other Tracking Technologies

We use cookies, web beacons, pixel tags, and other tracking technologies (collectively “Cookies”) when you use our Services. Through our use of Cookies in the Services, we may collect information such as the websites you visit before or after you visit the Services, how you navigate the Website, keyboard activity, mouse clicks and movements, your IP address, location information, search requests, browser type, operating system, cookie IDs, and the date and time you use the Services. Third-Party Sources

We obtain data from our business partners (such as our payment processor and service providers) that is necessary to conduct our business and provide the Services. We also obtain data from our marketing and advertising partners to improve our marketing and advertising. These third-party sources may collect Identifiers, Commercial Information, Internet Activity, and Geolocation Data on our behalf.

4. Purposes for Which We Collect Personal Information

To Communicate with You

To respond to your customer service requests or any other inquiry or correspondence, including responding to you through our live chat feature on the Website, to provide you with educational and informational content about the Services, to notify you of changes to our Terms and Conditions and this Policy, and to respond to your privacy-rights requests.

To Create and Maintain Your Subscription and Service Your Account

To complete your request for a subscription to the Services, to fulfill and manage your subscription, to maintain your payment information, to reduce the risk of fraud and process your refund requests and cancellations, and to create and manage your customer account, account information, and account settings.

To Market and Advertise to You

To serve advertising about products and services we believe may be of interest to you, to enhance our marketing capabilities, to notify you of new products, services, and promotions, to customize content, and to improve our ability to contact you.

To Provide, Manage, and Improve Our Services

To help us understand which features in our Services to improve or develop, to troubleshoot issues, to improve the content and functionality of our Services, to customize your experience, and to analyze our communications with you, Website traffic, use of the Services, and your feedback. We may also use Personal Information with our machine learning and artificial intelligence models, including but not limited to training such models, solely to enhance, improve, and provide the Services.

For Business Purposes

To inform our business strategies, to understand user demographics and preferences, to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as part of bankruptcy, liquidation, or similar proceeding.

To Process Job Applications and for Employment Purposes

To enable you to fill out our job application and submit application materials, to allow you to send email communications about your job applications or inquiries about our open positions, and to process and track job applications. For hires, we may collect Personal Information for background checks, drug screenings, and other information connected with the hiring process or employment.

To Protect Our Rights

To bring a legal action against you or anyone who may be causing harm to our Services, our customers, or to other users of the Services. To seek business, financial, or legal advice. To respond to subpoenas, court orders, and other legal processes.

To Comply with Our Legal Obligations

To respond to subpoenas, court orders, and other legal processes. To maintain business and financial records in accordance with applicable laws.

5. How We Use Deidentified or Aggregated Information

We may create, use, disclose, share, license, or transfer de-identified, aggregated data based on users of the Services. This data describes users as a group but cannot be used to identify you as an individual. We may use aggregated data to understand users’ needs, to determine user demographics and usage patterns, to determine what kinds of products and services we can provide, and to improve and enrich our products and the Website. We will not re-identify that information once aggregated or de-identified.

6. When Do We Disclose or Share Personal Information?

Below, we list the types of entities with whom we have disclosed or shared Personal Information in the last 12 months for business purposes or to serve targeted advertising or direct marketing, or for related purposes.

Website and App Hosting Service Providers, Email Service Providers, and Other Data Processing Service Providers

We may disclose Personal Information with service providers that host and manage our Services, maintain our customer service platform, provide email services to us, process job applications and onboard new employees, store and process data on our behalf and pursuant to our instructions, and support or provide for the security of our Services.

Website Analytics Partners

We may use your Personal Information to develop and improve the functionality of the Services, evaluate customer needs, or customize Website content and your browsing experience. We may use it to operate and troubleshoot problems with the Services or conduct statistical and other analysis of the Services.

Social Media, Marketing, and Advertising Partners

We may use Personal Information to serve targeted advertising to you, develop marketing materials, communicate with you about our Services, notify you of new products and programs, and inform our marketing and communication plans and strategies.

Government Officials / Law Enforcement

We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are contractually required to do so to fulfill audit requirements for government agency clients, (iii) if we are advised to disclose Personal Information by our legal counsel, or (iv) when necessary to identify, contact, or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, SnapProof Pro or any other party.

Professional Advisors

We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors, and business advisors, in their capacity as advisors to SnapProof Pro.

Change in Ownership

In the event that SnapProof Pro is the subject of a due diligence process concerning the sale of the company in whole or in part, through sale, merger, or acquisition, or in the event of a bankruptcy, receivership, or similar transaction, we may provide Personal Information to the prospective or subsequent owner(s).

When Explicitly Requested or Consented to by You

We may disclose Personal Information to third parties when you explicitly direct us to or consent to such disclosure.

7. How We Secure Your Personal Information

We take precautions to protect the Personal Information we collect. We have implemented commercially reasonable physical, technological, and administrative procedures to protect the Personal Information we maintain from loss, misuse, and alteration appropriate to the type of Personal Information processed. In the event of a security breach affecting your Personal Information, we will notify you in accordance with Washington’s data breach notification law (RCW 19.255) and any other applicable law.

8. Access by Children

The Services are not directed at children 16 years of age and under. We do not knowingly collect, use, or share Personal Information from children 16 or under. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information.

9. Third-Party Websites and Social Media

Third-Party Websites

The Services may link to websites that we do not maintain or control. SnapProof Pro is not responsible for the privacy or security policies or practices of any third parties or any third-party websites. If you choose to access third-party websites, you do so at your own risk, and you should read the terms and conditions and privacy policies for each website that you visit.

Social Media Websites

SnapProof Pro may participate in social media platforms such as Facebook, X, LinkedIn, Instagram, TikTok, YouTube, and Reddit (“Social Media”) that enable online sharing and collaboration. The Website may allow you to connect to and share information with these various Social Media platforms. By choosing to use any third-party Social Media platform or choosing to share content or communications with any Social Media platform, you allow us to share information with the designated Social Media platform. We cannot control any policies or terms of any Social Media third-party platforms. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy.

Services You Link to Your Account

We receive information about you when you or your account administrator enables third-party apps, or integrates or links a third-party service with our Services. The information we receive depends on the settings, permissions, and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with our Services.

Google Services and Drive Integration

SnapProof Pro integrates with Google services to enable optional features. When you choose to connect your Google account, we use Google’s OAuth 2.0 protocol to authenticate you securely without ever seeing your Google password.

What Google Data We Access

SnapProof Pro requests access only to the “drive.file” scope. This is a non-sensitive, limited Google Drive permission. It allows our application to:

  • Create new folders and files in your Google Drive that SnapProof Pro generates on your behalf.
  • Read, modify, and delete only the files SnapProof Pro itself has created, or files you have explicitly opened with SnapProof Pro.

SnapProof Pro cannot see, access, or modify any other files in your Google Drive — including files created by you or other applications. We have no ability to browse your Drive contents broadly.

How We Use Google Data

Project photos and reports you choose to back up are written to a folder in your Google Drive that SnapProof Pro creates. Once written, those files belong to you. We do not read them back, analyze them, train artificial intelligence models on them, or share them with any third party. We do not sell, rent, or trade your Google data under any circumstances.

Where Google Data Is Stored

Files you back up via SnapProof Pro are stored in your own Google Drive account, under your control. Copies of file metadata (such as filename, project association, and upload timestamp) may be retained in our application database to help you locate your backups within SnapProof Pro.

How To Revoke Access

You can disconnect SnapProof Pro from your Google account at any time by visiting your Google Account permissions page at https://myaccount.google.com/permissions. Revoking access stops SnapProof Pro from creating any new files in your Drive. Files already in your Drive remain there — they belong to you.

Compliance With Google’s Limited Use Requirements

SnapProof Pro’s use and transfer to any other app of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. The full policy is available at https://developers.google.com/terms/api-services-user-data-policy.

10. Additional Terms for Washington Residents

If you are a Washington State resident, the following additional information applies to you:

Washington My Health My Data Act (MHMDA)

The SnapProof Pro Services are designed for jobsite documentation and are not intended to collect, process, share, or sell “consumer health data” as defined under the Washington My Health My Data Act (RCW 19.373). We do not knowingly collect consumer health data through the Services. If you believe you have submitted consumer health data through the Services, please contact us at info@snapproofpro.com so we can address it. If SnapProof Pro begins collecting or processing consumer health data in the future, we will update this Policy to include the notices and consumer rights required by the MHMDA.

Washington Commercial Electronic Mail Act (CEMA)

If you receive email or text marketing messages from us, you may opt out at any time by following the unsubscribe link in any marketing email, replying “STOP” to any marketing text message, or contacting us using the information in Section 14.

Washington Biometric Privacy Law (RCW 19.375)

SnapProof Pro does not intentionally enroll, capture, or use biometric identifiers (such as fingerprints, voiceprints, or retina or iris scans) for any commercial purpose. While photos and videos uploaded by our customers may incidentally include images of individuals, SnapProof Pro does not use facial recognition or other biometric identification technology to identify individuals in those photos or videos for any commercial purpose.

Washington Electronic Communications

Washington law (RCW 9.73) generally requires that all parties to a private communication consent before it is recorded. When you contact our sales or customer service teams by phone, we will notify you if the call is being recorded. You may opt out of call recording by telling the representative you do not consent to the recording.

11. Additional Terms for Residents of California and Other U.S. States with Comprehensive Consumer Privacy Laws

If you are a resident of California, or of another U.S. state that has enacted a comprehensive consumer privacy law (such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Jersey, Tennessee, Indiana, New Hampshire, Minnesota, Maryland, Kentucky, Rhode Island, or any similar law, collectively “State Privacy Laws”), applicable law provides you with certain rights regarding your Personal Information or Personal Data. These rights are subject to limitations such as (a) exceptions permitted by applicable law and (b) verification of your identity.

In the event of a conflict between this Section and the remainder of this Policy, this Section shall govern for residents of the applicable states.

Your Privacy Rights

Right to Opt Out

Residents of covered states may request that we not sell or share your Personal Information for purposes of targeted advertising.

We honor opt-out preference signals, including the Global Privacy Control (GPC), where required by law. To learn more about the GPC, visit https://globalprivacycontrol.org.

Right to Access / Right to Know

Covered residents have the right to confirm whether we are processing their Personal Data and to request access to: (a) the categories of Personal Information we collected, (b) the categories of sources from which the Personal Information was collected, (c) the business or commercial purpose for collecting, (d) the categories of third parties with whom we shared Personal Information, and (e) the specific pieces of Personal Information we collected.

Right to Delete

Covered residents have the right to request that we delete their Personal Information that we collected from them. We will comply with such requests and direct our service providers to do the same, subject to certain exceptions permitted by applicable law.

Right to Correct

Covered residents have the right to request that we correct inaccurate Personal Information. If we receive such a request, we will use commercially reasonable efforts to comply. If necessary, we may ask for documentation showing that the Personal Information we maintain is inaccurate.

Right to Data Portability

Covered residents have the right to request a copy of the Personal Information that we collected from them in a portable and, to the extent technically feasible, readily usable format.

Right to Non-Discrimination

We do not discriminate against you for exercising any of your privacy rights described in this Policy.

We will take reasonable steps to verify your identity before responding to your request. The verification steps we take may vary depending on the sensitivity of the Personal Information and whether you have an account with us.

When We Will Respond

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. We may charge a fee to process or respond to your request only if it is excessive, repetitive, or manifestly unfounded.

Appeals

If we deny your request, you may appeal the decision by contacting us at info@snapproofpro.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within the timeframe required by applicable law.

Authorized Agents

You may designate an authorized agent to submit a privacy rights request on your behalf. We may require proof of the agent’s authorization and may require you to verify your identity directly with us.

Additional Information for California Residents

Categories of Personal Information We Have Collected.

During the past 12 months, we have collected the following categories of Personal Information: Identifiers, Customer Records, Protected Classification Information, Commercial Information, Internet Activity, Geolocation Data, Audio and Visual Information, Professional and Employment Information, Education Information, and Sensitive Personal Information (precise geolocation).

Categories of Personal Information We Have Disclosed for a Business Purpose:

During the past 12 months, we have disclosed the same categories listed above for a business purpose.

Sharing Personal Information.

In the last 12 months, we have not sold your Personal Information to a third party for monetary compensation. We may have shared Personal Information with third parties for the purposes of serving targeted advertising, including Identifiers, Commercial Information, Customer Records, Geolocation Data, and Internet Activity to the sources described in this Policy.

Sensitive Personal Information.

We do not sell or share any Sensitive Personal Information. We do not share precise geolocation data for the purpose of marketing or targeted advertising.

Shine the Light.

California’s “Shine the Light” law (Civil Code Section § 1798.83) allows California residents to request (a) a list of all third parties to whom we may have disclosed your Personal Information within the past year for direct marketing purposes, and (b) a description of the categories of Personal Information disclosed, by contacting us at info@snapproofpro.com. Please reference “California Privacy Rights” in your subject line.

Do Not Track.

Our Website does not honor Do Not Track browser signals at this time. We do honor the Global Privacy Control (GPC) signal where required by law.

12. International Users

SnapProof Pro is based in the State of Washington, United States. The Services are offered and intended for users in the United States. If you access the Services from outside the United States, please be aware that any Personal Information you provide may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by other jurisdictions. If you share your Personal Information when visiting the Services, you consent to the processing of that Personal Information in the United States.

If we begin to actively market or offer the Services to individuals in the European Economic Area, the United Kingdom, or other jurisdictions with comprehensive data protection laws, we will update this Policy to include any required additional notices and rights (such as those under the EU/UK GDPR).

13. Changes to This Policy

We may update this Policy from time to time. When we make changes, we will update the “Last Updated” date at the top of this Policy and, where required by law, provide additional notice (such as by email or by posting a notice in the Services). Your continued use of the Services after the effective date of the revised Policy constitutes your acceptance of the changes.
